Terms and Conditions

Your deposit is required to establish and hold a reservation to cover costs of accommodation, flights, admin fees and many other tour costs therefore your deposit is Non Refundable.

Your deposit guarantees your reservation for the tour, therefore it is non-refundable should you choose to withdraw from the tour for whatever reason. However, should EMCA cancel the tour, your deposit will be refunded.

No cancellation fees will be waived as a result of the following:

  • Injury or sickness.

  • Change of circumstances

  • Delayed, rescheduled or missed flights.

  • Climatic, social or political problems.

  • Covid 19 Border restrictions

Travel insurance is recommended to cover your costs incase of personal injury before and during the tour, we highly recommend obtaining travel insurance so you are not out of pocket if you need to cancel due to sickness, injury or any type of medical conditions. 

Covid 19 policy:

During 2021, the pandemic has been a huge challenge for Ellwood Motorcycle Adventures as it has been for many small  tourism businesses. We have suffered major financial loses due to cancelations from border restrictions and in good will we offered customers full refunds if they were unable to come on tour due to COVID 19 restrictions.

 As we move forward from the COVID 19 pandemic we realise that we need to learn to live with COVID 19 as being a part of our lives. We are aligning our terms and conditions to follow suit with other tourism operators in regards to COVID 19.

 To date no customer of Ellwood Motorcycle Adventure has lost any money with us due to COVID 19. Any client that fails to meet the requirements of border control for COVID 19 and is forced to miss the tour will be subject to the above cancellation fees.  These requirements include allowing enough time to quarantine upon arrival, requests by the tour operator to get a Covid test or be in the state by an allocated date.  We strongly suggest clients monitor controlled interstate borders and their status regarding your location. If at the time of the tour date you can not attend due to border restrictions your deposit and any payments made towards your tour can be transferred to another tour within 2 years. 

Our tours include public liability insurance, however it is up to the individual participant to obtain own personal insurance. Final payment is due 4 weeks prior to your tour and from this point no refund for cancellation will be given therefore we highly suggest travel insurance that will cover your tour costs if you need to cancel. Please read the terms and conditions on the travel insurance you chose to make sure it is appropriate for your tour and will cover you.

I am completely aware of the dangers of trail bike riding on and off-road. I take part in this trip at my own risk. I agree to the fact that neither Ellwood Motorcycle Adventures nor their representatives or their agents are responsible for damage to my person, belongings, financial loss incurred or for any other extenuating circumstances beyond their control. I am aware that Ellwood Motorcycle Adventures is not responsible for the behaviour of other participants.

I shall abide by local traffic regulations and those of the group trip. I will ensure that my behaviour and/or actions in no way cause harm to other people, local environment, or my hire vehicle. As far as is known to me, I am in good health and able to meet the required tour standards. I have a current valid motorcycle licence.

Our motorcycles have third party CTP insurance.

The rider is responsible for

  •   Any of the terms of the rental agreement

  • Damage to property that is caused by careless, wilful or reckless riding including whilst the rider is under the influence of drugs or alcohol 

  •   Damage to property is caused by submersion in water, such as river crossing, including salt water, resulting from rider negligence. All damages will be covered by the individual rider.

  •   The rider’s license being valid, current and appropriately rated for the motorcycle.

  •   The motorcycle was being ridden in an unlawful manner, such as on the right hand side of the road.

  • The participant is solely responsible for the ignition keys during the normal course of a riding day. Should they be lost or stolen due to neglect or failure to follow the tour leaders’ instructions the participant is responsible for the cost of replacement

Required Documents

  • Copy of current motorcycle licence or learners licence.

  • Terms and Conditions must be read and accepted. ( by ticking the terms and conditions when booking you have agreed to all Ellwood Motorcycle Adventure Terms and Conditions.

  • Release and Waiver, Assumption of Risk and Indemnity Agreement must also be signed in person at the beginning of your tour. We will provide a copy for you to sign.

 

Motorcycle tour packages do not include: alcoholic beverages, optional tours and sightseeing excursions, gratuities, travel insurance and insurance coverage for injury to the rider.

We have trained first aiders and are equipped with first aid supplies and satellite phone for any necessary first aid attention. You will be briefed on conditions daily of expected itinerary.

Before every tour begins, your motorcycle tour leader will give each participant a briefing about local speed limits, signage, and other applicable traffic regulations.

  • It is the participant’s responsibility to adhere to all traffic regulations. All local road rules must be complied with.

  • Participants must hold a valid motorcycle licence.

  • Helmets are mandatory.

  • Participants must be aware of traffic, road conditions, weather and other motorcyclists.

  • Participants understand that motorcycling is a dangerous activity and are aware of these risks and fully accepts these risks, and are solely responsible for keeping their motorcycle under control, selecting proper speeds and adhering to state laws.

  • Participants are solely responsible for their choice of riding style and speed selection even when following a motorcycle tour guide in convoy formation with other motorcyclists.

  • Participants ride at his/her own risk and are legally liable for injury or damage to fellow participants or other road users, whether being lead by the motorcycle leader or otherwise.

  • Participants must follow the directions of the motorcycle leader at all times.

  • The motorcycle tour leader reserves the right to terminate a rider’s motorcycle tour if he considers the rider is unsafe either to himself/herself or to others, or for offensive behaviour, and thereby forfeiting the balance of the motorcycle tour.

  • We will need to collect certain information from you, some of which may be of a personal nature. The information may be disclosed to our service providers to enable the services to be provided but will not be used for any other purpose.

  • We highly suggest you obtain travel insurance and Ambulance cover before the tour starts.

You acknowledge that travelling with Ellwood Motorcycle Adventures requires a degree of flexibility, good humour, and an understanding that the itinerary, accommodation and vehicles may change even after commencement, without prior notice due to local circumstances. Changes may occur because of force border restrictions and Covid 19 related restrictions, poor road conditions, weather, vehicle breakdowns or other circumstances beyond Ellwood Motorcycle Adventures control or which simply cannot be foreseen. 

Ellwood Motorcycle Adventures reserves the right to change any part, or the whole, of the arrangements contained within the website and tour dossier, should conditions or circumstances beyond our reasonable control determine such action necessary. In such cases, we will use our reasonable endeavours to provide alternatives of the same standard, quality and duration as the original itinerary. You will have the right to cancel your tour, in which case cancellation fees as outlined in the Booking Conditions and Trip Terms and Conditions will apply.

Ellwood Motorcycle Adventures does not accept any responsibility for loss of enjoyment, delays or compensation resulting from circumstances beyond our control. Ellwood Motorcycle Adventures is not responsible for any incidental expenses that you may incur as a result of changes made by us, including, but not limited to, additional accommodation, airfares or costs associated with changes to airfares.

You acknowledge that the nature of the trip is adventurous, and participation involves a degree of personal risk. You acknowledge your journey will have the usual risks of travel, and the additional risks that are associated with adventure travel and motorcycling. You accept these risks and the possibility of personal injury, death, property damage or loss which may result from your decision to participate in the tour or expedition.

Cancellation Policy

Your deposit is non-refundable. If cancelling after final payment and or instalments have been received:

  • More than 21 days prior to departure date – 50% is refunded of the remaining amount

  • Between 21 days and departure date – No refund

  • If making payment instalments an admin fee of $380 will be charged if cancelling after 50% of full amount has been received.

  • It is highly recommended that participants obtain travel insurance to cover costs incase of illness of injury.

  • If you can find a replacement rider to fill your position your deposit and final payment can be transferred to that replacement rider once they complete the booking form and agree to the terms and conditions

  • Please do not expect our small business to cover the cost of your cancellation fees if you choose not to have insurance.
